General Terms and Conditions of Sow and Peak Recruitment and Selection Agency

1. Definitions The following terms are used in these general terms and conditions: – “Sow and Peak”: refers to the recruitment and selection agency Sow and Peak, active in the Logistics sector, Dentistry & Oral Care

– “Client”: refers to a natural person, legal entity or organization that uses the services of Sow and Peak. – “Candidate”: refers to a natural person nominated by Sow and Peak for a position with the client.

– “Agreement”: refers to the agreement between Sow and Peak and the client, stating the conditions for the recruitment and selection of candidates have been recorded.

2. Applicability These general terms and conditions apply to all quotations and agreements and services from Sow and Peak. Deviating conditions are only binding if: agreed in writing.

3. Services Sow and Peak provides recruitment and selection services in finance and IT sector. Sow and Peak will make every effort to present suitable candidates to the client, based on the information provided by the client information and requirements.

4. Confidentiality Sow and Peak treats all information it receives from the client as: confidential. This information will be used solely for the purpose of carrying out the agreed services. Sow and Peak will take appropriate measures to: to ensure the confidentiality of the information.

5. Selection process Sow and Peak will conduct a selection process to identify suitable candidates identify. This process includes screening resumes, interviews and vetting of references. However, Sow and Peak cannot guarantee that every candidate meets the client's expectations.

6. Liability Sow and Peak is not liable for any damage or loss arising from the selection procedure, the candidate's services or the use of the services provided by Sow and Peak proposed candidate. The client is responsible for taking of the final decision regarding the selection and acceptance of the candidate.

7. Fee Sow and Peak charges a fee for the services provided. It fee is agreed in the quotation or agreement and is exclusive VAT. Payment must be made within the agreed term, unless otherwise stated agreed in writing.

8. Intellectual Property All intellectual property rights relating to the Sow and Peak materials provided, such as reports, assessments and recommendations, remain owned by Sow and Peak. The client exclusively obtains the right to: use these materials for internal purposes in relation to recruitment and selection of candidates. It is not permitted to use these materials without it to copy with the prior written permission of Sow and Peak, reproduce, distribute or disclose to third parties.

9. Confidentiality Sow and Peak and the client undertake to keep confidential information confidential information they receive during the execution of the agreement is confidential keep. By using the services of Sow and Peak, the client agrees agree to these general terms and conditions. If there are additional or different agreements are made, these must be recorded in writing and signed by both parties.

These general terms and conditions have been drawn up in Dutch. In case of differences in interpretation between the Dutch version and its translations, the Dutch version prevails.
